These Terms of Use ("Terms") are a binding agreement between you and Lendea Inc. ("Lendea", "we", "us", or "our") governing your access to and use of our website, applications, and embedded financing services (together, the "Services"). If you use the Services on behalf of a business, you represent that you are authorized to bind that business, and "you" refers to that business.
1.1 Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. Business financing is available only to eligible businesses that meet our and our bank partner's underwriting and verification requirements. We may decline, suspend, or limit access at our discretion and may verify your identity and your business (KYC/KYB) before providing Services.
1.2 The Services & financing
- Lendea provides embedded payroll financing — a business line of credit and "Pay Over Time" advances made available within payroll workflows, including those operated by our platform partners.
- Any credit, advance, limit, or pricing shown is an offer, not a guarantee, and is subject to approval, underwriting, and the applicable financing agreement you enter into at the time of a draw.
- Lines of credit and advances are issued by our bank partner and serviced by Lendea. The terms of any financing are governed by the separate financing agreement, which controls if it conflicts with marketing materials or this website.
- Repayment is typically collected by automatic direct debit on the schedule disclosed at origination. You authorize those debits when you accept a financing agreement.
1.3 Accounts & acceptable use
You are responsible for the accuracy of information you provide and for activity under your account and credentials. You agree not to misuse the Services — including by attempting to access them unlawfully, reverse-engineering, scraping, interfering with their operation, submitting false information, or using them to violate any law or third-party right.
1.4 Intellectual property
The Services, including the Lendea name, logo, text, design, and software, are owned by Lendea or its licensors and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose. No other rights are granted.
1.5 Disclaimers & limitation of liability
Except as required by law, the Services are provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, Lendea will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from your use of the Services.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law — including, where they apply, mandatory consumer guarantees under the Australian Consumer Law, non-excludable rights under UK and EU consumer law, and any other rights that cannot lawfully be waived. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.

- From the payroll/platform relationship: payroll cadence and amounts, funding history, and related business data used for eligibility and underwriting.
- Financial & credit data: bank-account and cash-flow information you connect, and business and personal-guarantor credit information obtained from credit bureaus where permitted.
- Automatically: device, log, and usage data, and cookies or similar technologies used to operate and improve the website.
2.2 How we use information
We use personal information to provide and operate the Services; to verify identity and prevent fraud; to underwrite, decision, fund, and service financing; to communicate with you; to comply with legal and regulatory obligations; and to improve our products. Our legal bases (where the GDPR applies) include performance of a contract, our legitimate interests, compliance with legal obligations, and your consent where required.
2.3 How we share information
We share personal information with our bank partner and service providers (e.g. identity verification, payment processing, cloud hosting, analytics) who act on our instructions; with platform partners where you use Lendea through their payroll product; with credit bureaus and fraud-prevention agencies; and with authorities where required by law or to protect rights and safety. We may share information in connection with a merger, financing, or sale of assets. We do not sell personal information for money, and we do not "share" it for cross-context behavioral advertising as those terms are defined under US state privacy laws.

Lendea is based in the United States, and your information may be processed in the US and other countries whose data-protection laws differ from yours.
